1. ELECTRICITY ACCOUNT LISTED AS CLEAROUT

In 2001 Ms. G moved out of her rented apartment and arranged to have the service disconnected and reconnected at her new address. As instructed the electricity company connected a service at the new address but failed to send a final bill to Ms. G.

Despite knowing Ms. G’s new address, the electricity company listed her as a “clearout” one of the most serious forms of default which is reserved for fraudulent activities or a person who no longer intends to meet their obligations in respect to credit.

After being unable to obtain finance for several years Ms. G was referred to Latham Moore who investigated the matter and found a several serious breaches of the Privacy Act 1988 and the Essential Services Code.

After entering into confidential terms of settlement with Ms. G the clearout listing was removed.
