Defaults & Judgement Removals

Latham Moore understands that the affect of a “bad mark” against a persons credit file is so sever that even a small default may prevent a person from obtaining any form of credit for 5 years or up to 7 years in respect to a “clearout”.

This initial matter led to the establishment of a service helping consumers remove credit impairments from their credit files. Prior to its incorporation, the key management at Latham Moore successfully operated in this field for many years.

In 2001 Telstra made a key decision to sell its debt ledger to Alliance Factoring a wholly owned subsidiary of the Baycorp bureau.

Telstra sold and Alliance bought approximately 1,200,000 individual Telstra landline and mobile phone accounts for as little as 10c in the dollar in June 2002. After buying the overdue accounts, Alliance set about loading the debts onto its parent companies database as payment defaults.

This led to thousands of consumers being defaulted on old Telstra debts many of which had been contested and written off by Telstra only to be reinstated on their debt ledger as due and payable debts. One particular default related to a businessman who had been referred by his local Bendigo Bank manager after being refused a home loan due to a recent default listing by Alliance Factoring. This default turned out to be one of the old Telstra accounts.

This led to hundreds of similarly affected consumers contacting Latham Moore for assistance.

This matter is now under investigation by the ACCC who as of the 5th May 2005 have made a formal demand on Alliance to produce documents under Section 155 (1)(a) of the Trade Practices Act 1974.

Latham Moore & Associates and has helped hundreds of people who have been default listed by companies like Alliance Factoring restore their credit ratings allowing them to move on with their lives.

Today, Latham Moore not only helps individuals and corporations alike to restore their credit worthiness but also offers a comprehensive range of sound commercial business advice in a number of key areas.

Inaccurate defaults impact on the Australian economy

Every incorrect or non compliant Default removes a consumer from the general economy.

A consumer with an incorrect default will more than likely be rejected for credit and therefore will be excluded from participating in the purchasing of goods and services on credit such as motor vehicles, houses and other consumables.

Baycorp is the largest privately owned consumer credit reporting database in Australia and New Zealand. It reputedly holds information on over 13,000,000 individuals and 1,000,000 companies.

Of this number Baycorp claim to hold default information on 2,000,000 corporations and individuals.

In recent media reports Baycorp claim that their database holds less than 1% in inaccuracies.

This is at odds with a recent study by Choice magazine which found inaccuracies in 4 out of 10 of the consumer files it examined.

Even if Baycorp’s figure are correct, this represents 130,000 Australians which may have been refused credit or may be paying penalty interest rates on mortgages for a default that should not have been reported in the first place as it was inaccurate or non compliant with consumer protection laws.

For Australian businesses this means that a finance rejection could have been the result of an inaccuracy.

For the big Banks who reject or impose harsh penalties on consumers who apply for mortgage finance, they have allowed a significant market share slip away to non companies like Blue Stone and liberty who specialise in non conforming applicants.

Latham Moore’s process & procedure

Latham Moore carefully documents every one of its default removal cases.

These cases have been formulated into a national database of credit providers who are known to have abused the credit reporting system for their own benefit or who openly flaunt consumer protection laws.

This information is freely passed on to consumer groups who can use the information to offer advice to their clients.

When we receive an application for a default removal Latham Moore is able to quickly identify systemic problems occurring in the internal controls of credit providers.

In some cases persistent abuses maybe referred by Latham Moore to an external government agency such as the ACCC who have the power to investigate offences under the Trade Practices Act 1974.

Latham Moore encourages reform in the private sector and has worked closely with credit providers to develop or understand their obligations under the Privacy Act.
